Adobe Perks Terms and Conditions (“Terms”)

Effective December 4, 2023

THESE ADOBE PERKS TERMS AND CONDITIONS (“PERKS TERMS”) AND THE ADOBE GENERAL TERMS OF USE (“TOU”) GOVERN YOUR USE OF ADOBE PERKS PLATFORM (“PLATFORM”) AND THE LINKING OF PARTNER OFFERS ARE “SERVICES” WITHIN THE MEANING OF THE TOU. THE PERKS TERMS ARE HEREBY INCORPORATED BY REFERENCE (INCLUDING, WITHOUT LIMITATION, TERMS RELATED TO GOVERNING LAW AND VENUE). IN THE EVENT OF INCONSISTENCY BETWEEN THE TERMS OF THE PERK TERMS AND THE TOU, THE PERK TERMS WILL CONTROL.

  1. Access and Eligibility. Adobe Perks is a platform (“Platform”) providing offers and discounts supplied by third-party providers (“Partners”) to Adobe customers in the United States, United Kingdom, Australia, Germany, Canada, Brazil, France, Italy, Netherlands, Spain, Portugal, Argentina, Switzerland, Poland, South Africa, Austria, Ireland and Korea who have an active, paid subscription for Adobe Creative Cloud All Apps, Single App, or Photography Plan subscribers only (each, an “Adobe Subscription”). Your right to use and access the Platform and the Partner offers, discounts, products, and services (each, a “Partner Offer”) is conditional upon your Adobe Subscription status. Your access to Partner Offers ceases immediately upon the termination, suspension, or expiration of your Adobe Subscription until you renew or purchase a new Adobe Subscription or, in the event of a suspension, until Adobe resumes your Adobe Subscription. Free memberships are not eligible.
  2. Partner Offer Codes and Discounts. Adobe provides links or codes to Partner Offers on the Platform in good faith. These links or codes are provided to Adobe by Partner solely for use on the Platform and may not be posted elsewhere. Sharing links and codes is strictly prohibited and may lead to the termination or suspension of your access to the Platform, Partner Offers, and/or Adobe Subscription. While Adobe endeavors to ensure all links and codes work as expected, occasionally links and codes may not work. Adobe does not guarantee that the Partner Offers linked to on the Platform will work and if the Partner Offer does not work as expected, Adobe will not be liable to honor any linked Partner Offer. Partner Offers linked on the Platform may be withdrawn at any time and without notice by the relevant Partner or Adobe. Adobe may update the Platform at any time and without notice to reflect the current Partner Offers available.
  3. Responsibility. Adobe provides access to Partner Offers and does not endorse, have control over, or accept any responsibility for the contents of Partners’ links and websites or Partner Offers. Your use of Partner Offers is subject to the Partners’ terms and conditions and privacy policy applicable to the relevant Partner Offers. For the avoidance of doubt, Adobe does not act as an agent, distributor, or reseller of Partner. Adobe will not be liable for any loss or damage incurred as a result of any interaction between you and a Partner and any Partner Offer linked on the Platform. All matters related to the Partner Offers, including but not limited to, any delivery of goods, products and services, pricing, returns, and warranties are solely and strictly between you and the applicable Partner.
  4. Contact. If you are experiencing any problems redeeming Partner Offers, please contact the relevant Partner directly. Partner’s contact information will be available on the Platform or on the Partner’s site directly. Adobe does not accept any responsibility for issues redeeming Partners Offers or any links or codes related to such Partner Offers.
  5. Updates to Terms. Adobe may make changes to the Perk Terms and notify you by revising the date at the top of the Perk Terms and/or may provide you with additional notice. Any such changes will not apply to any dispute between you and Adobe arising prior to the date on which Adobe posts the revised Perk Terms incorporating such changes, or when the Perk Terms otherwise become effective. You should look at the Perk Terms regularly. Unless otherwise noted, the amended Perk Terms will be effective immediately, and your continued use of the Platform confirms your acceptance of the changes. If you do not agree to the amended Perk Terms, you must stop using the Platform.
